Here's the thing toodles: During a trial his rap sheet will come into play. But, at the time of the incident in question NO ONE INVOLVED KNEW OF HIS PAST POLICE RECORD. So his defense lawyer will have minimum use of that information.

And yes, the "system" did fail him....but keep in mind that it is the REPUBLICAN PARTY THAT HAS CONSISTENTLY VOTED AGAINST ANY ADDITIONAL FEDERAL FUNDING FOR MENTAL HEALTH FACILITIES FOR THE GENERAL PUBLIC (state or federal).

His now outraged family knows... why didn't they do anything to help him until he put himself into another situation...one where he lost his life.... because he was threatening others and even threatening to cause harm to himself ..
It's unbelievable that the family actually said people didn't try to help him..
They weren't helping him..

I hear from my daughter it’s a common occurrence and that most don’t hurt subway passengers, should they still be restrained?

Lethal force is permitted to defend yourself or someone else against an immediate threat on their lives. Do you believe, based on the description of what happened, that an unarmed Neely was an immediate threat on someone's life, which would justify lethal force by Penny?

Yes. When you threaten serious bodily harm and have the means to do it it justifies the use of lethal force.

If they are threatening to kill people certainly they should be restrained. Should those that would hurt people not be restrained. And you never answered my question.

How were they threatened? That’s the real question.

I’ve loved Subway cars because of the possibility of a threat, but I don’t think anyone deserve to be killed over it, or even put in a headlock
