Creating a militia without the authority of the state was considered treason. It was dealt with harshly.

There is no prohibition on the states keeping troops, and in fact they are constitutionally allowed to keep troops. Congress has the right to cut off funding to the Federal Army, but not the state militias. In fact, appointing officers, and a fair bit of the training is specifically reserved for the states.
