I am arguing for an individual's right to be secure in their person.
That is literally the right that was rejected by this ruling. LOL. However, I am not saying that is why we should do this. I can't believe we haven't already. Rather than just beef up welfare and let folks walk away from what they created based on "women may lie" I would support an entity we create to affirm responsibility so I don't have to pay for your irresponsible behavior.
And again, the state's need to know overcomes the right... So what we do is negate that need by providing a way to get the needed information (are you the father) without the information regarding their/your person, the DNA record, coming into possession of the government by ensuring it isn't the government testing the samples and requiring the data set to be kept private from the government (your DNA does not go into a government database) and that after a certain period the data set is destroyed (like gun checks, but without the government entity doing the destruction of records or having the information).
I get that you don't want the government to have access to information, and therefore have provided a means to allow you to be responsible for your children, and only your children, without the government having the means to obtain information which you do not want them to have. At this point courts will get warrants based on exactly what you are objecting to, giving the government access to your personal information that you otherwise do not want them to have. I seek a better and more private solution. Other than saying "women could lie" and refusing to pay for your children do you have any suggestions that would make it "better" for you?
I don't care that you want to donate sperm to the mother but refuse to take responsibility in any way and want to say the reason is that women might lie. The child's right to have those responsible for their existence to pay for it is paramount. And again, if we require women who "guess" wrong to pay for the tests if they were wrong my bet is that there will be far less "lying"...
