because "settled law" is basically stare decisis, and stare decisis alone is not a permanent construct
It's why we have a written Constitution.
Only the text is permanent. interpretations and implies rights from such are not
It doesn't mean deference isn't given to stare decisis,but if a SCOTUS decides there is no true underpinning of such - it can be removed if the court so chooses.
