No. A Senator can believe the impeachment articles are accurate still not merit removal. Nothing to do with guilt or innocence. As one impeachment manager said, it is about fitness for office.

If the articles are found to be accurate but not worthy of removal it means the President is found to be "not guilty" of an offense deserving removal. Re Nixon again, he and everyone else believed he would be found guilty of alleged offenses deserving removal from office. The term you quoted, "Fitness for office" is a Senate trial equivalent as "not guilty" in a criminal case.

Just as a jury votes to convict or acquit with no reason required to be given. On a charge such as insurrection against The United States jurors could hold the opinion that the specific alleged conduct was true beyond reasonable doubt but came short of insurrection.

Similar but different. A "vote of no confidence" is an exercise in political pressure, pressure that can be irresistible. Impeachment and removal are exercises under law.

No confidence vote means you lose your job as prime minister.
 
Trump was impeached of course. However, neither impeachment nor indictment are within the authority of the panel, nor was the the evidence now known available earlier, as any serious person is aware. What Cheney is saying is that the investigation by the panel has found additional evidence to refer to the Justice Department for an indictment.
Which would have had zero to do with a Senate conviction, as trump's co conspirators would protect him to the death.

Objectively impartial jurors are not only not required they are impossible to obtain, there are no rules of evidence, no standard of guilt beyond a reasonable doubt, no possible loss of liberty or financial penalty other than that from getting kicked out of office, but The Constitution itself cloaks impeachment in criminal terms and leaves an impeached President vulnerable to indictment for the same conduct, if criminal, once removed.

Yes, the Const. talking about "high crimes...." is very confusing. If the DOJ will not indict a President, how can there be a crime?
 
I just said how. If the conduct is a crime under the law it's a crime committed by the President who is specially protected only by the policy of the Justice Department for being prosecuted while in office.
