However, neither impeachment nor indictment are within the authority of the panel, nor was the the evidence now known available earlier, as any serious person is aware. What Cheney is saying is that the investigation by the panel has found additional evidence to refer to the Justice Department for an indictment.

A President can either be removed or not removed. Nothing to do with innocence.
A trial following impeachment is meant to have something to do with innocence. If a President is found not to have done what he is charged with, and if the alleged conduct he is found not to have done reasonably merited removal from office if he HAD done it, then he can fairly be deemed to have been found "innocent". In a fraudulent proceeding like the Trump impeachment trial, on the other hand, these concepts have no application; they only should have had application. Nixon resigned because he believed he would have been convicted, i.e., not found "innocent".
