I disagree. I've been in the IT field for 15 years, self taught, no formal schooling whatsoever. It can be done because I'm doing it, right now.

I guess what I want to know is how you think Sotomayor misapplied the law, not why you dislike the outcome of the case.

It is my understanding that she tossed out promotions based on the fact that no minorities qualified for the promotion. Is that not the case?

but again, you see racial discrimination as diversity where I see it as......discrimination.

I'm all about diversity. I work with Indians, Muslims, Blacks and Asians. I served with them as well. I have no problem with anyone of any race or gender who pulls their own weight and treats others the same. It's those who prefer that 'minorities' be given advantages over others because of the nature of their birth that is the issue.
 
She fits the mold of Obama politics.

However, I do applaud her decision in the CT firefighters case.

Obviously the tests have little to nothing to do with performance. The decision was in the best interests of the city .. in my opinion.

I am not familiar enough with their tests. Were they racially biased? If they had nothing to do with the job, then why do they exist?

you shouldn't think I don't like you because I think you hate men. I don't like you because your arrogant and elitist liberal ideas tend to override even the slightest pretense polite and logical discussion. The fact that you're a man hater just makes me think you're a man hater.

The short version is that the City of New Haven tossed out the test results because it properly determined that if it certified the results it would violate Title VII because the test has a discriminatory impact. The trial court opinion explains why the City acted properly and its reason for tossing out the results was not a pretext for intentional discrimination against white people. The appeals court opinion basically says that the City had no good options and, as unfortunate it may be for Ricci and the others, its actions did not violate Title VII.

Did the trial court examine the test or have any expert testimony about it, or did they just accept the cities testimony that they were racially biased? This is where I get leery of the court system, for their seeming inability to determine that a city is capable of falsifying information in a trial.

just because they believe it had a discriminatory impact (lets assume it did) that is not a violation of title vii....you need more than just a discriminatory impact....you need intent, there is case law for this, but i will simply give you title vii law....

nor shall it be an unlawful employment practice for an employer to give and to act upon the results of any professionally developed ability test provided that such test, its administration or action upon the results is not designed, intended or used to discriminate because of race, color, religion, sex or national origin

what exactly is nonsense? i provided you with the law, are you incapable of reading the law and applying it to the facts in this case? please show me one thing i posted that is not true, wrong or doesn't make sense.

do you believe that by failing to certify the test results, this altered the test results, in that, by failiing to certify the results, the test scores became meaningless, e.g., altered?
