No, per the story they found it was a live birth and the DA is deciding if they will file charges.

If the DA files charges, it will be over how the deceased fetus was handled and not over the abortion procedure itself.
and putting aside the fact that a 22 week abortion in itself is disturbing. I'm disturbed over some questions of procedure.
Why was this woman given drugs to induce dilation and contractions and then sent out to her car? Why wasn't she kept in the clinic under observation after this medication was administered?
Who administered the medication? A member of the staff or the attending physician?
Why wasn't the attending physician on site when the artificially induced premature birth occurred?
What are the State of Florida's procedures for these circumstances and did the clinic staff implement these procedures (obviously it doesn't appear they did) and if they did not, why not?
Why wasn't the deceased fetus managed according the established procedure and regulations?
Was there an intent to hide the fetus to avoid legal repurcusions?
