Pursuant to law, Congress asks IRS Director for 6 years of Trumps tax returns. . .

Do you realize the precedent you are setting by letting Trump get away with so much? Do you see a way that could bite you in the ass later?

What exactly is Trump getting away with? So far all we see are whiny buffoonish rants that lack any legal basis. What crimes has Trump been charged with?

No they won't. They will only release personal returns with the approval of the tax payer, OR, in a closed session of Congress. If there are any leaks of that information, the "leakers" will go to prison.

So what is the purpose of such a Fascistic demand?

Right so the IRS will be the ones releasing them to the House Chairman in closed session, right? It will be the IRS doing the releasing right? That is what I said, that it would be the IRS correct?

Trump responds that he is not inclined to honor the request.

AOC burns him good, "We did not ask you!"

OK.....Rachel Maddow....has this horse not been beaten to death once already? :bigthink: Perhaps you nor Maddow have ever heard of "Executive Privilege"? Any act that would hinder the US president of carrying out his duties of the office....yada, yada, yada....as established by SCOTUS precedent. The United States v. Nixon. Since these IRS documents predate the presidency of Donald J. Trump....any attempt of Congressional Subpoena will quickly be meet with a challenge of Executive Privilege. In order to stop this separation of powers......the bloviators in congress would have to prove that a CRIME has occurred....kind'a of a case of the mule attempting to push the plow, as congress goes fishing for a crime to prosecute.....while the country burns to the ground because the president is not free to carry out his executive duties as established by constitutional decree.

According to the law, if you are the Chairman of the House Ways and Means Committee you do.

Only in CLOSED session dumb fuck. Then there is always the question on what legal basis should the Ways and Means Committee demand such a thing? What laws have been violated?

Or has the Democratic Party of the Jackass devolved so much, they think they can conduct fishing expeditions against their political opponents like a Fascistic third world shit hole?

On what grounds will the law be challenged?

Honestly, I don't know. I am not a pretend lawyer. But, I am sure that lawyers much smarter than you will have an argument. Now I suspect that you won't agree with it because you are such an expert. But, in the end what you or I think doesn't matter does it?

This will end up at the Supreme Court. If you don't think so, you are fooling yourself. But, like I said, you fooled yourself that Hillary would win and that Mueller would take down Trump over collusion so............

Do you really think the courts will uphold that Congress can just willy nilly look at anyones tax returns without having a good reason? You don't think the Courts will have a due process concern about it?

Lots of information in tax returns that can be taken out of context that could be used to harm people personally and/or politically.

I also think it will matter whether or not Congress has used this power before don't you? I mean it is one thing to have it in law, but if they have never used it until now I think they will be forced to explain why now don't you?

Just because you can doesn't mean you should does it Brad?

26 U.S.C. 6103(f)(1)...

(1) Committee on Ways and Means, Committee on Finance, and Joint Committee on Taxation
Upon written request from the chairman of the Committee on Ways and Means of the House of Representatives, the chairman of the Committee on Finance of the Senate, or the chairman of the Joint Committee on Taxation, the Secretary shall furnish such committee with any return or return information specified in such request, except that any return or return information which can be associated with, or otherwise identify, directly or indirectly, a particular taxpayer shall be furnished to such committee only when sitting in closed executive session unless such taxpayer otherwise consents in writing to such disclosure.

United States Code says you get to.....!!!!

What part of "only when sitting in closed executive session unless such taxpayer otherwise consents in writing to such disclosure do you continue having difficulty comprehending?

On what legal basis can the committee demand someone's returns? Simply because they are from the opposition party and the committee chair doesn't like them?

pursuant to what law? what probable cause to investigate -the IRS is the enforcement agency, not Congress

Same law that NIXONS returns and FORD'S returns. Not even a question that CONGRESS can have them.

Not to mention "MAZARS", the accounting firm that put together Trump's financials to SECURE LOANS. They apparently sound quite cooperative, 'just send us a subpoena'.

For more than a decade, Mazars and a predecessor firm signed off on financial statements for Trump that he used
when seeking loans. Some of the statements include
frequent exaggerations or inaccuracies and were accompanied
by a note from the firm saying it was not responsible for the accuracy of the information.

“The accounting firm told us that they will respond and they just want a subpoena so we . . .
we’ve got to figure out how to accommodate them,” Cummings said. “But apparently it would mean a
friendly subpoena, I assume.”

Thanks for admitting you know of no legal grounds for a challenge. Now, where did I say Mueller would take down trump over collusion? I always maintained I did not know if there was collusion but I would wait for the Mueller report, which they are currently sitting on.

On what grounds will the law be challenged?

That depends on what reasoning the Chairman uses to obtain the tax returns. Is their criminality involved? If so, what?

We've recently concluded a very BROAD $40 million investigation into this which has resulted in NOTHING criminal being found. What else do you think he can find?

SO you are admitting I was correct, the IRS will be releasing them to the Chair of the House committee?

You seem dissatisfied with the Special Prosecutor's report being released to the AG.

Are you stipulating that a release of the presidents past six tax returns to a closed session of Congressional committee will be sufficient evidence of anything?

That does not contradict what I said, now does it... ?

Only in the sense that you believe that the Chairman of the Ways and Means committee can demand tax returns simply because he wants them. Typically, at least in the real world and legal sense of the world, their needs to be a purpose for such a request.

So what purpose do you think the idiot Cummings can use to obtain Trumps personal tax records IN CLOSED session and to what purpose will he use them?
