We're both making assumptions here, but mine is based on the premise that a man's behavior doesn't suddenly change from pure evil to docile just because he ran out of ammunition in the gun that he just shot up a church full of people with.

I'd err on the side of caution and fill the bastard full of lead.

Since you have addressed several things, in your rant, please allow me to address them individually:
1 - The article I quoted has actual quotes from those that were in the Church, where as yours "essentially" made an assumption and provided no proof.
2 - You are free to hate the Constitution and it's Amendments; but you really need to accept the fact that it's "essentially" going to stay as it is.
3 - You're "essentially" wrong; but I digress.

Your own girlfriend said the shitbag ran from the church carrying a pistol which backs up my assertion that some UNARMED congregation member wrestled the rifle out of his hands.

I know how badly it would hurt you to acknowledge that it didn't take a gun to disarm this guy, but there it is.
