Depends upon the officer charging the driver and what other behavior the driver was engaging in, like swerving in and out of traffic, skidding around corners, jumping curbs, smoking the tires etc, etc.

If the driver was on a basically straight line highway with no other traffic around or residential areas close by, maintaining control of the vehicle by staying in one lane and not exhibiting any other behavior that could be considered reckless, then it would most likely be a very expensive speeding ticket.

Many things have to be taken into consideration prior to filing criminal charges against someone who failed to follow to the letter, govt data transmission guidelines, the main one being intent. If someone committed a simple oversight, like failing to notice a small letter (c) at the beginning of a paragraph and transmitted that data to an authorized recipient over an unsecured server, that would be totally different than intentionally handing over printed paper documents to a female reporter one was screwing on the side, or a foreign agent, etc., for the intentional purpose of disclosing secret info to an unauthorized recipient. It is even different than "accidentally" taking unauthorized paper documents home in violation of the law.

Who, other than rabid, salivating dogs like you, has legally defined her actions as "grossly" negligent? Nobody, that's who. Look up the definition of the term...

Gross negligence is a conscious and voluntary disregard of the need to use reasonable care, which is likely to cause foreseeable grave injury or harm to persons, property, or both. It is conduct that is extreme when compared with ordinary Negligence, which is a mere failure to exercise reasonable care.

Second: The statute specifies "....delivered to anyone in violation of his trust." She NEVER delivered ANY classified info to unauthorized recipients like Petraeous did.

Third: No classified info was "....lost, stolen, abstracted, or destroyed."

I don't blame Comey though. He should never have ben put in that position -FBI is investigative.
This was a DoJ call.
Circumstances appear that BClinton got on the plane to derail the investigation ( impeach Lynch).

But Lynch should have kept any recommendation in DoJ ( like an assistant). it never made any sense
to leave it on Comey's desk. I think she knew he would cave given that unwanted responsibility.
