In a book called Three Felonies A Day, Boston civil rights lawyer Harvey Silverglate says that everyone in the US commits felonies everyday and if the government takes a dislike to you for any reason, they'll dig in and find a felony you're guilty of.

The average professional in this country wakes up in the morning, goes to work, comes home, eats dinner, and then goes to sleep, unaware that he or she has likely committed several federal crimes that day. Why? The answer lies in the very nature of modern federal criminal laws, which have exploded in number but also become impossibly broad and vague. In Three Felonies a Day, Harvey A. Silverglate reveals how federal criminal laws have become dangerously disconnected from the English common law tradition and how prosecutors can pin arguable federal crimes on any one of us, for even the most seemingly innocuous behavior.
 
We know two of the crimes were theft and there were two other non-violent crimes, according to the article. I'd like to know what those two were.

"The theft of the $159 jacket, taken in isolation, carries today a six-month jail term. It was combined at Jackson's sentencing hearing with his previous convictions – all for non-violent crimes including a robbery in which he took $216 – that brought him under Louisiana's brutal “four-strikes” law by which it became mandatory for him to be locked up and the key thrown away."

I didnt say that this was 'fair.' But that is their law and at the time, it was classed as a different felony.

And to be honest, I really could not care less if people that serially commit felony crimes against other persons get put in jail for life.

However that is just my personal feeling. Instead, I support a view more in line with the Constitution....and life for a few non-violent crimes seems like cruel and unusual punishment.

I also dont support it because it *probably* costs more for the taxpayers to support them for life (hard to say when you add in the costs of more future trials, costs of future crimes.....all those 'jackets' add up, and the costs financially and emotionally to their victims)


But as I said Annata...I have changed my position on 3 strikes laws for the same reasons I dont agree with zero tolerance policies, based on what you wrote early on in the thread. Thank you.

Tax evasion is a felony. And the point I'm making that it's that easy to commit one, while being completely unaware that you're doing so.

Everybody knows tax evasion is a felony.

However there is a certain amount that constitutes a felony. $5 undeclared doesnt equal a felony.
