he might refuse to accept the dismissal, in which case he would be appealed and likely overturned.....
The judge kept delaying sentencing to give Flynn a chance to retract his plea...he refused to retract that plea for a year.
But the bigger problem with this for Flynn and Trump is that the DOJ will need to provide evidence and reasons for why the charges should be dropped.
I wonder how you can be "TOTALLY EXONERATED" from charges that you pleaded guilty to -- twice?

But the bigger problem with this for Flynn and Trump is that the DOJ will need to provide evidence and reasons for why the charges should be dropped...and they failed to do that in their motion, which means the judge will likely call DOJ lawyers to the stand to explain why they are seeking to drop the charges. Thing is, they have to provide an actual reason because if the only reason they are doing this is because Trump wants it, then that's a separation of powers violation and the DOJ attorneys could face disbarment, contempt, or even share a cell with Flynn.
