Because war is a state of affairs between nations. It cannot be anything else. You can't say the United States is at war is something that is intangible (terrorism). That's a concept that predates the United States (and every other nation) and will certainly outlast us as a nation (and every other nation). You imply that terrorism is an act of war, but in every instance thus far it has not been (9/11 is a partial exception).
