Why is Brennan obstructing justice

I don't think so. First, somebody has to actually obstruct justice. He has no authority to order anybody to do anything. Because some worker respects his opinion does not give them the power to withhold documents. Brennan's intent does not apply.

And I was using a ‘liberal’ application of law like what gets used against Trump. I’ve heard some lefties claim Trump was guilty obstruction for what he said on Twitter about the Mullet investigation.

Except it would be *criminal* intent if Brennan is trying to hinder the investigation to protect himself or others from prosecution.

In contrast, Trump knew he was innocent of the collusion charge so it would be impossible for him to have criminal intent in any obstruction case. In fact, if Trump so much as *suspected* the investigation was corrupt he had legitimate grounds to try and obstruct it.

In fact, it could be argued he had a responsibility to do so in order to protect the office of the presidency.

This is exactly why Mueller punted on obstruction, he knew he could never win in court. Don't buy the BS line about the DOJ memo which says a sitting president can't be indicted. If Mueller thought he had a case for obstruction, he would've challenged that.

This is exactly why Mueller punted on obstruction, he knew he could never win in court. Don't buy the BS line about the DOJ memo which says a sitting president can't be indicted. If Mueller thought he had a case for obstruction, he would've challenged that.

There was a reason besides the DOJ regulation-excuse that Mullet didn’t indict Trump. I agree that the best explanation is he knew the charge was weak and would never stand up in court.

3) Which witnesses is he tampering with?
4) What power over those “witnesses” does he have, other than his opinion, does he have to constitute tampering?

Especially since the Mueller investigation was never obstructed. Mueller was never fired, and received unprecedented cooperation from Trump. Furthermore, how do you obstruct a bogus investigation? In all reality, Trump had every right to put a stop to this fraud of an investigation, he had every right to fire Mueller. I was one of those saying he should've fired Mueller. In hindsight, I was wrong. By not firing Mueller, he has all the political capital he'll ever need to counter investigate. Now that he has released the Kraken (declassified), the Dems are quivering in their wadin' boots. Looks like Nadler literally stroked out the other day, lol.

They were begging Trump to fire Mullet. In fact, I think some of Mullet’s more ‘gratuitous’ moves [the over the top raids on Manafort and Stone] were done for that exact reason. And I don’t doubt that Trump was prevented from taking the bait by some of his advisors.

To claim Brennan tampered with a witness or obstructed justice would mean any citizen who gave a similar opinion would be guilty of the same crime.

This is a big stretch to claim Brennan did anything wrong. It is like many of our posters who make accusations of treason that are not even close to the real thing.

If I were his lawyer I’d counsel against making such statements—particularly, in light of the legal exposure Brennan has already.
