Wahhhh I don’t get a Jury Trial!

I watched about five minutes of Fox News yesterday. I’m show called The Five. And it must be called that because they are able to get five lies in every five seconds. They were going on and on about how a jury trial is a fundamental right, and it is being denied to trump.
I don't believe a jury trial was an option here. Heard something about that this morning on public radio.

And even if Trump's team had made such a request, it's not clear he would've gotten a jury, anyway, given the nature of what New York Attorney Letitia James is seeking, including what's known as "disgorgement" of financial benefits obtained through fraud. The bottom line is that there can be legal disputes over whether parties are entitled to juries, depending on what's at stake in a given case. And regardless of whether Trump's lawyers had a master plan when they declined to press the issue, it's unclear they would have been successful had they done so.
In a statement on Tuesday, Trump lawyer Alina Habba said a jury trial was never an option in this case:
The Attorney General filed this case under a consumer protection statute that denies the right to a jury. There was never an option to choose a jury trial. It is unfortunate that a jury won’t be able to hear how absurd the merits of this case are and conclude no wrongdoing ever happened.

It was Habba's fault. When the box for a jury trial was not checked by his staff of attorneys, it was obvious they wanted a bench trial. So he ruled in a summary judgment. It went against them, and they wanted to change their minds. Of course, Trump and his people accept no blame. It was a lefty plot. Trump picked them so they are the best.

Bet it was done deliberately because they knew they were going to lose whether by bench trial or jury. So this way they can now pretend that poor persecuted Donald was denied his rights as an American because this is all a POLITICAL WITCH HUNT. Wait for it.

Well, his lawyers did waive his right to a jury trial. If he didn't direct them to do that he would definitely have grounds for an appeal. If, however, they can show he did direct them to do that then he's got nada for appeal on that.

Wrong, there is no ineffective assistance of counsel in a civil case. He could sue his lawyers, but the civil case won’t get overturned because of that.

Sorry, Betty, but as usual you are wrong. It will turn out that his lawyers deliberately did not request a jury trial, just so that when he inevitably loses, he can blame it on denial of rights. You know, exactly the same swill that you just swallowed.
 
You dont have to ask for a jury trial, you nnitwit. The 7th amendment guarantees you get a jury trial.

This is a civil trial, you nitwit (notice correct spelling). The 7th deals with criminal trials.

The Seventh Amendment requires civil jury trials only in federal courts. This Amendment is unusual. The U.S. Supreme Court has required states to protect almost every other right in the Bill of Rights, such as the right to criminal jury trial, but the Court has not required states to hold civil jury trials.

Second, Trump is an eternal optimist. He probably thinks he could persuade the great unwashed mouth breathers up there that he was being persecuted. It’s why he needs to be surrounded by lawyers.
Third, from what I’ve heard directly from Alina Habba, a jury trial wasn’t even an option in this case. The prosecutor filed this crap under New York executive law 63 (12). Nobody “forgot to check a box” or even request a jury trial. The worst possible outcome for this BS seems to be that Trump will no longer be able to do business in New York. I would have ran from that dumpster fire a long time ago.
