They had their own flag, constitution, and Article I/II/III institutions. In fact, former President John Tyler was elected to the CSA Congress. This presents an interesting point to me. The CSA Constitution called for a single-term president elected for six years. Tyler had already served as US President for nearly four years. Would he have been eligible to serve as CSA President, or not? If the answer is yes, then, the Confederates were not Americans.
The 13th amendment hadn't been ratified on April 15, 1865. How could there have been former slaves?
