Yes, his texts are a smoking gun of the intent of the Trump administration to overturn the election but not necessarily commit treason.
Not a lawyer, but isn't it illegal to overturn an election using fake electors and faked documents?
If prosecutors have a "giant smoking cannon" they prosecute. Merrick Garland is a political hack too... if there was even some soggy wet gun powder looking substance he'd say something about it, a "giant smoking cannon" would have him indicting folks. If they were a "giant smoking cannon" there is no need to pretend you are going to try to "flip" him, you already have a "giant smoking cannon"....

I keep hearing about all this bad stuff that's on the laptop but have yet to see any of it and I won't believe any of it until I see it with my own eyes.

Sorry but you're missing the point: Saying "a smoking gun" means nothing unless it leads to a conviction.
It's not what everyone knows happened, it's what can be proven in court. A criminal court.
Not a lawyer, but it seems to me if sufficient evidence was produced that Trump instigated a riot, and violated both his oath and the law, then couldn't he be sued by everyone who was harmed? The five that died? The injuries to police? Even the injuries suffered by Trump fans? Heck, even the dead terrorist's family could sue Trump for starting the riot....and/or letting it go for hours when he could have stopped it as many of his staff and in Congress pleaded for him to do. Civil court is just majority vote with a lot more latitude in presenting evidence.
The minimum justice all Americans should see is to break Trump financially. Shatter TrumpCo, burn it and scatter the ashes. What him quietly die at his home sanitarium....while Melania parties.
