There is only one Constitutional path when there is no clear winner via Electoral College and Electoral votes accepted and certified by the President of the Senate (Pence).

Put aside the fact this would have been a 'fake' case of no clear winner as the Constitution never contemplated fraud in the process, but had Pence gone along with the fraud and no certifying of the Electoral College happened in the Senate, the Constitution then requires it move to what is known as a Contingent Election .

The House makeup (only the House votes) had the GOP with the majority of seats based on how they are counted in a Contingent Election, meaning if the GOP with a majority vote could have put back in Trump as POTUS.

Some people say 'The Supreme Court would never allow that'. By the Constitution the SC actually has no role here via Separation of Powers. Once the States complete their certifications and submit them then elections are run by the President of the Senate by counting and certifying the election by the required date, OR, throwing it to a Contingent Election, if he cannot do it due to real issues.

So even if the Dems got the SC to hear it, the SC could either say, 'this is not our role, this has to be done thru the VP or House', or like they did in Gore V Bush, they can offer a ruling that many Constitutional experts said back then was really just an opinion, as they have no role.

So lets say the SC said to Trump and House Republicans 'that was wrong, Pence should have certified those votes', do we think Trump and House GOP stand down and just hand it over or do they tell the SC to stay out, as they have no Constitutional role?? I know which i would bet on, thus driving the country into a massive Constitutional crisis.


BTW there were some arguing for AL Gore to not accept the SC ruling, as President of the Senate, and someone who was shown after in many recounts to have actually won the election versus Bush. But Gore commented on that, and that if he refused it would tear the country apart so he was stepping down, even though he did not agree. He die not have to.

That Bush Jr win was largely orchestrated by Roger Stone, who came up with much of the plan and who, at the last minute, riled up a mob to rush in to the main recount center (violate the law) which ended up stopping the recount. Then the GOP claimed the ballots were no longer secure, as a result of the mob (they sent) gaining access to the recount room. And it was that court fight, ultimately, that lead to the SC saying 'we must count only the votes that are in now, as the certification date is final'. So you can see why Roger Stone and Trumpians thought a variant of that mob, stopping the count, and Pence's count of the Electoral ballots, might also win. That it would be the Dems, like Al Gore did, just stepping down to prevent the catastrophe, that Trump and the GOP would have been threatening the country with.

I don’t think Trump would have been that patient, nor felt bound by the rules, especially if protest and public opinion were threatening. Once he declared Martial Law, everything was on the table

The saddest part to me is not that you have a criminal like Trump willing to try this and who could find some criminal supporters in the fringe. No the saddest part is the 100 or so 'R Congress people' lead by Ted Cruz who were ready to over throw a free and fair election regardless of what that would do to America simply because they thought they could see a path to succeed in doing so.

It just show how completely broken and devoid of all ethics or any care for the country the right has become. That win at any and all cost is the only goal, which was reaffirmed in the Debt Ceiling crisis that was narrowly averted.

Yup.

This coup attempt was really part 2 of the Bush V Gore plan that WORKED to ensure a count could not be completed that would see Al Gore become POTUS.

GWBjR was ahead by a tiny margin and they wanted to 'stop the count' in FLorida. They could not stop it legally, so Stone arranged a mob to protest, as per their right, but then that mob was incited to rage and broke into the recount offices and room. So immediately the count had to be stopped.

It was that fight, mainly that lead to the SC saying the vote needed to be certified as it was, as there was no longer enough time to do a recount, before the certification date, and the SC ruled that date could not be moved via the Constitution, so 'too bad for Al Gore, even if you would have won, stopping the count and the certification deadline means you do not'.


Many on the left were outraged by that because the Gore legal team asked that the count continue while the SC heard the case. That way if the votes should be considered there would be no delay and if not they could just throw them out. The SC did not allow that. The count remained suspended while they considered the case and ruled, and then they used the 'we are out of time' as reason to rule against Gore.
