The term is obstruction. Pence and Biden did none of that. They also immediately returned the classified documents they found. The cases are not similar in any major way. They just both dealt with classified documents.

- "Establishes that Presidential records automatically transfer into the legal custody of the Archivist as soon as the President leaves office."

What that means is they MUST be handed over to the Archives immediately. The Archivist holds them in storage.

So in Obama's case the archivist set up a storage for him and maintained custody, in "ChinaTown" the entire time.

Clinton tapes were full of military intelligence like about Kosovo for example and the Judge said they belonged to Clinton because of the Presidential records act. ANY record that Trump retained was his property because of the Presidential records act. Trump is going to win this case.

That is not how the OBAMA judge ruled in Clinton sock drawer case. She said the President and the President alone gets to decide what Presidential records are. So Trump and Trump alone gets to decide what is a Presidential record.


Judge Amy Berman Jackson agreed: “Since the President is completely entrusted with the management and even the disposal of Presidential records during his time in office,” she held, “it would be difficult for this Court to conclude that Congress intended that he would have less authority to do what he pleases with what he considers to be his personal records.”

Biden and Pence were not the President and Trump was. The Presidential records act says the President gets to decide what is a Presidential record . EVERY record in Trump's possession is covered by the PRA so what they did wasn't legal but what Trump did was.
