Trump was POTUS and he could declassify anything he wanted to. Jack Smith on the other hand may need to face the gallows.
 
The intent just begins with his failure to return documents when requested, and then lying about them being returned. Then we possibly have the espionage act in play.

Law enforcement was investigating Trump for three main possible infractions: the concealment, mutilation or removal of records; obstruction of justice, including the destruction, alteration or falsification of records in federal investigations; and violations of the Espionage Act, which can include the refusal to turn over documents relating to national security upon request as well as transmitting or losing such information.

Why? Because he's investigating the theft of classified materials?

There is a process that has to be done in order to declassify secret documents. There is no indication or evidence that Trump did any such thing. Just thinking about it doesn't work, despite his claims.

Who did trump show them to, who did he discuss them with, who did he give them to?

Changed? Hmm. I've maintained all along that he should be arrested and put on trial for espionage, obstruction, lying/perjury, and possibly treason connected to the documents. In that NBC link I provided, when asked if he showed the documents to anyone, he didn't outright deny it. From the link: "Asked if he showed classified documents to others, he answered, “Not really…I would have the right to,” later adding, “not that I can think of.”

You either did or did not defy a subpoena and refuse to return materials while swearing you had returned them all, rather than return them.


In this case Trump DID defy the subpoena and he did lie in a sworn deposition, and that is the crime even if he says 'but i did not intend to do it'.


You need to understand the law he broke before commenting again.

the problem is Trump did not declassify the materials he took.


So saying 'he had the power to' while true, does not mean he can take and keep them even if he did not, which he didn't.

By not declassifying them and going thru the proper procedure to seek to get permission to keep them he broke many laws. Because even if declassified (which they were not) they are still government documents he cannot keep.
