What makes this particular law stupid? Experience. Long ago we tried prohibition on a drug that is used by most of the population. It caused a black market with the violence that comes with it. Instead of learning from the past we simply repeat it here. IMO, that makes it stupid.
However, in the case of a law as stupid as this particular one where MJ and Heroin are the "same" and worse somehow than cocaine therefore we need to empower gangs to shoot each other in the streets because we said so is absurd.
The continued argument today is that we should put these people in jail because. The reality: these states have shown that the drug isn't more dangerous than cocaine and that less children are using it where it has been legalized....
