cops at least good ones know when they are in danger and when someone is holding a hose.

The article said police were called to the site. Let's say they drove over and were inside or stooping behind the police car. They could have pointed their guns at him and told him to drop whatever was in his hand before they fired.

They were on site for 5 or 10 minutes, I think. And were trying to set up containment. The problem was that there was a fear he would start shooting at other apartments. The article said he had been pointing it at them.

this is a possibility, i wasn't in the situation and if a reasonable person would believe their life in imminent danger, then they are justified in self-defense....

i really think we need more facts, like was teh guy saying anything, making any other motions....its a split second decision, if the guy knew they were there, and then pointed what looked like a gun at them and what neighbors said was a gun, then it is possible they believed the only way to protect their lives and possibly others was to fire first

At the time, Zerby, 35, was on a friend’s porch in Belmont Shore, holding a water nozzle that a neighbor thought might be a gun.

Apparently, unbeknownst to Zerby, police arrived and surrounded the area.

When police say Zerby appeared to be pointing what they thought was a gun toward one of the officer’s positions, police opened fire.

Autopsy results revealed that Zerby was shot 12 times in the chest, arms and lower legs.

maybe THIS is one of those reasons that cops should WAIT to see what the person is holding or doing before opening fire, even if he wasn't 13.

But Long Beach Police Chief Jim McDonnell, who was in court for the verdict, said he was disappointed by the decision.

He says the officers were cleared in an internal probe and still defends their actions.

“Their actions, we believe, were in immediate defense of life,” McDonnell said. “That’s the way we judge — based on the circumstances known to them at the time."

guess not. that whole officer safety thing needs to be observed, especially if they panic at garden hoses.
