(a) Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both.
(b) For purposes of this section, the provision of documents and materials to the Congress shall not constitute an offense under subsection (a).
(c) In this section, the term "classified information of the United States", means information originated, owned, or possessed by the United States Government concerning the national defense or foreign relations of the United States that has been determined pursuant to law or Executive order to require protection against unauthorized disclosure in the interests of national security.

Neither Pence nor Biden obstructed, and is said by Prosecutors often 'it is not the crime but the cover up' that often gets people in the biggest trouble.
For instance, Bill Clinton's affair with Monica was not even a crime but his cover up, lying to the FBI, was.
None of Pence, Biden or Trump was facing charges simply for taking the documents home as long as they gave them back and cooperated.
Pence and Biden did. Trump not only did not but he engaged in a web of lies, written perjury, and deceitful actions, many of which were caught on security video, to hide documents and NEVER give them back.

No prosecutor would prosecutor would ever prosecute on that as a person is not guilty of a crime if it cannot be established beyond a reasonable doubt.

If the Prosecutor states for FACT that the evidence "does no establish Mr. Biden's guilt beyond a reasonable doubt', his opinion that it would be a tough prosecution regardless due to Bidens age, is meaningless.
If i say 'we have no evidence to charge Terry' but in the course of our interview we found him so painfully stupid that we doubt any jury would convict him, as they would struggle to believe he could form intent, that latter part is just gratuitous.
If the Prosecutor states as fact that he was unable to find evidence 'to establish Bidens guilt beyond a reasonable doubt' what it the point in GUESSING what a jury would do, if he had enough to go to court, when he does not.

If you cannot establish guilt beyond a reasonable doubt, you cannot say a person is guilty.
But yes he did what Comey did, almost certainly to feed the Magat base some red meat, especially after seeing how Weiss and Durham are now hated on the right, for not giving the right anything to use.
Matt Gaetz even threatened this in Congress, when dressing down Durham, saying something along the lines of 'if we give you all those years to investigate we expect SOMETHING'. Meaning even if you cannot charge the person, as their is not evidence to do so, GIVE US SOMETHING TO USE.
