not true....the 9th can and does have en banc

you think it is "massive" only because of the geographical scope....look at some the circuits in the east and compare the population....however, it would not surprise me if the 9th did break up if the population in the west continues to grow.

The 9th has twice the population of the 11th, which is the second biggest court. It has three states with massive populations within its borders. The other states, I guess, probably don't contribute much to the population. It may make sense to split it between California and the rest. That would still leave the California court the biggest in the nation.
