Arizona's sweeping immigration bill allows police to arrest illegal immigrant day laborers seeking work on the street or anyone trying to hire them. It won't take effect until summer but it is already having an effect on the state's underground economy.

4th amendment law, yes.

here's the scenario:

COP: scuse me, your ID please.

ME: no, but thank you.

COP: you're under arrest for obstruction, hindering an investigation, and failure to obey a lawful order.

ME: outstanding, when can I call my lawyer for being arrested without committing a crime?

You can't arrest someone for not providing an ID or their name if you're initiating a consensual contact.

Otherwise we woiuld have to lock up all yuppies as drug users, all red necks as wife beaters, all mexicans as drug smugglers, all blacks as gang members, and your family for incest.
