The law allows lawsuits if there is a fetal heartbeat. How is it determined if the fetal heartbeat existed at the time of the abortion?

The development of the heart is a key element in the operation of the new law.

Only if the abortion occurred after a fetal heartbeat. If it occurred before then no lawsuit is possible (from what I understand).

Seems like that issue could determine the outcome of some cases. I assume a jury trial is allowed to determine whether the plaintiff is entitled to the $10,000.
