That the Bill of Rights is intended as a limitation on the power of the FEDERAL government ONLY, not the states, and that any federally elected person, conservative or not, that votes in favor of laws that interfere with these things is breaking their oath to support and defend the U.S. Constitution.

The Founding Fathers debated this issue quite thoroughly. There were many in attendance who wished to have us become a consolidated, national government. James Madison repeatedly tried to grant the federal government the power to negate all state laws. He was soundly defeated each time.

We would've been much better off had he succeeded. The biggest mistake of the founders was giving too much power to the states. It caused ridiculous amount of divisions and seasonally threatens to tear apart the entire union, while preventing the United States from adopting the unified, sensible economic plan that the federalists wanted to implement.
 
However, the Supreme Court and the Federal government also have no right to tell my state that they MUST or must not allow concealed handguns or any other weapon. You see, the federal government must stay out of things that don’t concern them. The Second Amendment remember, is part of the Bill of Rights, which in turn limits the FEDERAL government ONLY.

The same with Marriage. If the people of your state want to allow Homosexual marriages, which I am against on moral grounds, so be it. Either fight to repeal it or move. How dare the Federal government and Nancy Pelosi tell me and my neighbors that I have to have Homosexual marriage or not.

Not true. I don’t believe that every action presently being taken by the federal government is illegal. Only those activities for which it has not been delegated authority.

Per article I, section 8, congress has a specific set of powers, most of which it is currently exercising:
The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

To borrow money on the credit of the United States;

To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;

To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;

To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;

To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;

To establish Post Offices and Post Roads;

To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;

To constitute Tribunals inferior to the supreme Court;

To define and punish Piracies and Felonies committed on the high Seas, and Offenses against the Law of Nations;

To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;

To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;

To provide and maintain a Navy;

To make Rules for the Government and Regulation of the land and naval Forces;

In addition, the constitution, in amendment 10, states:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

My contention, which you call extreme, is that when the delegates of the several sovereign states of America met to establish their compact, they debated extensively on what particular powers they wished to delegate to this new agent of theirs. Many powers were suggested, and some were included while many others were rejected. One has to conclude that the union then has only those powers that were considered, debated, and approved for inclusion.

For example, at the convention, a motion was made that the union be delegated the power to emit bills of credit (paper money). This motion was rejected, and that power was not granted to the congress. One then must conclude that congress has no power to emit bills of credit.

And so it goes for all the other powers. Congress was either granted some power, or that power was withheld from congress. So in the end we have a union that has been delegated a specific and limited set of power, and these powers are recorded in article I, section 8.

Also, given that all other power are retained to the states and the people, whenever the federal government exercises an unauthorized power, it is infringing on the reserved rights of the people of the sovereign states.

I'm curious. In what way would you say that DamnYankee is making up his own version of the constitution? I what way is it different from what you consider to be the real constitution?
