They then gave this part of it over to the Executive in the statute previously listed above. It isn't that difficult to understand. He is fully within his given authority to write a travel ban from a list of nations, Congress wrote the statute... And they have the power to grant that authority... Simple path, easiest case ever to bring before the SCOTUS that ever existed.

Nevertheless, if the code or statute violates the Constitution, the Constitution trumps.

My prediction:

Trump wins. The Constitution gives "plenary" power to Congress over immigration. Congress then gave some power to the executive branch, vis a vis, the code Grind posted. This is not to say that the executive branch now has plenary power, rather, that Congress has very broad power over immigration and in giving some power to the Executive branch regarding immigration, I do not see how the judicial branch can rule against Congress and the Executive branch when that power is plenary, and even under the most strictest scrutiny, Trump wins due to national security reasons.

That's funny watching you play amateur lawyer. The Hart-Celler act makes such an EO on such a basis as discriminating on the basis of national origins clearly illegal. So Congress has told the President "You can't do that".

In my opinion, that act is not applicable here. The issue was quotas, not national security.

It matters not if the congress granted the authority to the executive branch... An unconstitutional order is still unconstitutional...
 
With the Court System stoping Trump's "executive order" in its tracks and illustrating a limit to his perceived absolute power I have been watching all weekend to see what happens next.

I was concerned that Trump would refuse to follow the rule of law and would instruct his administration to enforce the travel ban, despite the ruling, the Administration has obeyed the rule of law. I don't know if that was due to Trump's instruction or their own patriotism, but it is a good sign.

There are many indications that Trump does not understand or care about the separation of powers and that he was going to attempt to rule by decree as a king. It appears that, at least in this instance, he will bow to the power of the judiciary when they say he has overstepped his bounds. It is a good sign that my primary concerns of totalitarianism are, at least for the moment premature.

Were you concerned about Obamas totalitarian tendencies lol?

I understand that. The reality though is that virtually all recent terrorist attacks by foreign Muslims on our nation was by Saudi nationals and that EOs, like this, obfuscate that fact.

That is to say we have not been attacked by Syria, Somalia, Iran, Iraq, Sudan, etc., but we have been attacked and thousands of US citizens murdered by Saudi nationals yet the Saudi's have free entry into our country. What is wrong with this picture?

It matters a hell of a lot if Congress, using their plenary power grants some of that to the EB.

I didn't exactly see President Obama banning entry of Saudi's into our nation and he opposed US. Citizens filling civil suits against Saudi Arabia for their tacit support of the 911 terrorist.

What is again being obfuscated is that the largest source of Islamic radicalsation is the State sponsored Wahabiist movement in Saudi Arabia. If there was a true concern by our government to protect us from Islamic radicals they would confront them. It appears access to Saudi Oil is more important than American lives.
