Nearly 1 in 3 Republican candidates for statewide offices that play a role in overseeing, certifying or defending elections supported overturning the results of the 2020 presidential race, according to an Associated Press review.

They include contenders from one end of the country to the other, often in pivotal swing states, for positions that are the linchpins of democracy.

In Michigan, Kristina Karamo, a community college professor who signed an affidavit to a lawsuit seeking to throw out President Joe Biden’s win, is running to be the state’s top elections official. The election was overtly unconstitutional as the Governors and state secretaries unilaterally usurped the plenary power of the state legislatures to set voting laws and regulations in order to eliminate all voter chains of custody through unsolicited universal vote by mail, elimination of signature verification requirements, legalized ballot harvesting, and widespread use of unsecured drop boxes.

Yet, no state court found their state election unconstitutional. Only the state an decide if the legislature passed constitutional legislation---unless you think the federal government should intervene in state politics.
 
All politicians and journalists watched the election returns come in wed morning nov 4 and they know the election was stolen though most won't say it. Trump had 10% leads with 70% of the vote counted in many states - and then it all vanished.

The federal SC decided the election in 2000. Not much was made of it because bush and gore were the same - pure establishment.

The 14th Amendment prohibits the states from violating equal protection. Florida was using different methods of counting votes in different counties. The federal courts can determine if a state violated constitutional provisions

In 2020 the state legislatures passed the laws regarding election procedures. Only the state can decide if those laws were constitutional. The states modified the administration of those laws which does not mean the legislature did not pass the laws under its constitutional power. Laws are often modified in practice due to differing circumstances--that does not make the law unconstitutional.

The motion filed by Texas includes the 41-page complaint and a 35-page brief making the legal arguments for why the Supreme Court should grant approval of the filing of the lawsuit, since Article III, Section 2 of the Constitution gives the Supreme Court—not lower federal courts—original jurisdiction over “controversies between two or more States.”

The complaint goes into great detail describing what happened in each state.

Pennsylvania: The complaint accuses Pennsylvania Secretary of State Kathy Boockvar of, among other things, “without legislative approval, unilaterally abrogating” Pennsylvania statutes that require “signature verification for absentee or mail-in ballots.” These changes were “not ratified” by the Pennsylvania legislature.


Georgia: Similarly, the complaint describes how Georgia’s Secretary of State, Brad Raffensperger, also “without legislative approval, unilaterally abrogated Georgia’s statute governing the signature verification process for absentee ballots.”


Michigan: The complaint states that Michigan Secretary of State Jocelyn Benson “abrogated Michigan election statutes related to absentee ballot applications and signature verification.”


Wisconsin: Lastly, the Wisconsin’s elections commission made similar changes in state laws without the permission of the legislature that “weakened, or did away with, established security procedures put in place by the Wisconsin legislature to ensure absentee ballot integrity.”



The complaint catalogues these and numerous other changes made in all four states by government officials, not the state legislatures.

We are not talking about the U. S. Constitution. The question was whether the law was consistent with the state laws and constitution. There was no question that the state legislature passed the law about voting regulations. The only question was about whether deviations in the administration of that law were consistent with state regulations and no state court found they violated any regulations. There is always considerable discretion allowed in carrying out laws that may be affected by circumstances such as weather, pandemic, etc. And, none of those changes in procedure would have changed the outcome of the election. That is for each state to decide.

None of those court cases presented any evidence of voter fraud.
