This is not a jury trial, it was a simple question from the very man Trump wanted as SM. Its obvious that neither Trump nor his attorney's will use a defense that the documents were declassified, because they know they weren't.

Whether or not these documents were declassified, is a moot point. They belong to the government and not trump. trump knew this, but refused to return them. He stole them.
