Sotomayor Reversed AGAIN!!!

Minority candidates scored higher on the oral examination than on the multiple-choice written exam. The weighing of the two parts of the test had a disproportionate impact on minorities because the written test was weighed more heavily than the oral examination.
And had they decided after viewing all the tests that they were going to weight to the written heavier than the oral then you might have a point. But to say that in hindsight minorities did better on the oral so that SHOULD have been weighted more heavily is skewing the test to favor one race over the other.Chris Rock said it best, if every thing else being equal the black guy does just as well in the interview, or on the test or whatever, then fuck it, choose the black guy. This test was fair and it was created with New Haven's past in mind. I am not going to argue that all things being equal, they SHOULD have made race a determining factor. As big a supporter as I am of AA I can't do that in this case.
 
Empathy is fine in the law, as long as it doesn't drive your decision. I've felt bad for people before, although the decision by the court was correct.

I'm glad that in this case I didn't have to feel bad for them and the court made a good decision at the same time.

Bush threw the libs a bone when he appointed her. It was good PR at the time, but clearly, she's unfit, having made such terrible decisions as this and the other recent case in which she opined that a student couldn't exercise free speech on a personal blog

So accordingly to YOU, the Shrub appointed an incompetant clearly for political voting points for his party.

Hmmm, sort of undermines all that unwavering support of all things Shrub for the past 8 years, doesn't it?

Given her right of centrist make-up, the Shrub got a good choice to accent all those Bob Jones University law grads he stocked the Justice Dept. with.

Sotomayer, being the bigot she is, didn't even see fit the hear the case of the firefighters.....didn't bother to hear the evidence....dismissed their case out of hand.....judging their complaint by relying one her own racism and bigotry to make a determination ....

That shows she is unfit to be even a lower court judge, let alone a JOTSC....

Only women, especially if of 'hue' should be first considered. Following should be men, with good butts and nice skin tones, anything but pale. Language, any that is less difficult to learn than freaking English, which is very difficult for natural born, whoa with ESL.
 
Ah the irony of it, a judge follows the law, the scotus legislates, something the conservatives say they should not do and then the nominee is criticized. Life requires special scorecards.

Personally I see this as a decision that benefits a more equitable solution to this situations as it puts more focus of real evaluations as opposed to paper tests .. which had been the argument all along.

I can't see this even being a factor in her confirmation. It may be brought up, but it certainly won't stop her. You and I agree on the benefit of the decision as well. With the added thoughts above...

I dont particularly like her decision on this case. But that does not make her a bad nominee. While I belive diversity on the court is one factor that should be considered when choosing a nominee.... it is not the only factor.

Considering we had only one woman on the court... I am not against the idea of him looking for a qualified woman and giving the fact that she was a woman some weight. I also am not against her getting a plus because she is a hispanic. But those should only be smaller factors to more important issues. The fact that she came from a less advantaged background to achieve great success is a larger factor in my opinion.

We agree.

This won't be a factor given that both Roberts and Alito have been on the wrong side of eventual SC decisons.

As a country we don't know what to do about discrimination in the municipal workplace. Hopefully, this will lead to better solutions.

Well, counselor, you seem to have trouble understanding what a disparate impact Title VII case is all about. And you don't seem to grasp the basic fact that the 60-40 weighing of the two portions of the test skewed the test to favor one race over another. It favored the white folks.

And this case has absolutely zero to do with Affirmative Action.


Edit: And I advise you, again, to read Ginsburg's dissent. You might learn a thing or two.
