Should a person who commits AWDW and a minor crime be given a life sentence?

In this context it was a carjacking.

Although, after having read about the particularly violent nature of the carjacking he participated in, and the comments of his parole officer, it makes me wonder if the parole board even bothers to look at their history before granting them parole.
 
i don't see what difference the weapon you are holding makes... it should be the crime itself. If you raped someone with a banana is it ok?

Well if I threaten you with my fists it's clearly not as bad an assault as if I threaten you with a gun or a knife. If I threaten you with a gun, I'm showing a reckless disregard for your life.

And rapes with using a deadly weapon are usually of a particularly heinous nature. I think that's one of the differences between rape one and two in most jurisdictions (although I'm not a legal scholar).

It's california so it's doubtful they even opened the file. Remember, the governator is proposing the release of thousands of imprisoned inmates just to save money.

Well I don't think there's a mandatory minimum unless it's a gun (in most states), and even if you got the maximum I don't think it's life in prison (in any state). You may even get probation. The prosecutor would probably drop the charges if you'd tell them it was me.

well i am addresing your question. Lets say you sleep with my daughter and I am mad, so I enter yourself to yell at you, while waving my baseball bat. Is that a life sentence since I broke into your home?

No Grind. I don't even think AWDW is even punishable by life imprisonment.

The judge takes the context and the weapon used into account. If it were just waving a baseball bat I think it could possibly even be reduced to a simple assault.
