government/law definition aside(because tyrants can make anything up they need to) the national guard is not the militia. It is a reserve army of the states that is constitutionally allowed by the feds via Art 1, Sec 10, paragraph 3

The National Guard is the national militia. It is not any State militia. The National Guard answers to the President of the United States (which we currently don't have).
State militias also exist. The Washington State militia currently has 75 members, mostly administrative staff, since that militia is no actively defending against anything. The federal government does not have to 'allow' State militias. States have the inherent right of self defense, just as you do.
