i'll ask this question again, since nobody seemed to want to answer it.......isn't it police standard procedure that if you shoot an individual that has a gun, they move the gun far away from that persons reach, dead or not, so that it's not accessible or within reach? the only reasonable answer to have a gun in close proximity to the now dead victim is that it was placed their to provide cover for a shoot that was unjustified.

Why should what the item is matter? Does it change the fact that you STOLE because it's something of someone else's you don't think makes much difference? That you tried to steal it is the ONLY thing that matters. There's an easy solution. Don't steal.
