This case and the phelps case are chipping away at free speech. OF course these are horrible people. But we're setting precedents that will diminish free speech in the future.

How can taunting just be deemed assault?

Assault is a willful attempt or threat to injure someone else, and an apparent, present ability to carry out the threat such as by flourishing or pointing a dangerous weapon or device at the other. An "assault" may be committed without actually striking or injuring another person. If you swing your fist at someone but miss, if THEY thought you were going to hit you, it is assault. If you drive a car at someone and miss, but they thought you were going to try and run them down, that is assault with a deadly weapon and is a felony in every state in the union.
