Red Flag Law- Extreme Risk Protective Order

no point in you debating abstract Constitutional principles here. I've gone over and over this.
This has become a national exigent circumstance -for all the abstract discussions ( which are fine)
there is a pressing need to do something to stop these deranged minds.

from my understanding of the Constitution it was never meant to stop legislation to regulate those rights .
If you have problems with this - i suggest you take it up with SCOTUS

there is NOTHING in the constitution that states that the government can ignore their limits in times of national distress or exigency. your understanding of the constitution appears to be lacking then, but of course falling back on SCOTUS as your 'authority' has it's own drawbacks like when they rule on abortion, etc

here's a question for you.......is the judiciary a part of the federal government?

I do understand that. it's how so many states/cities got away with license requirements and other infringements to keep blacks and native americans unarmed...........

what would happen if license requirements were done away with? more people could afford to buy a gun for their protection.

I think licenses/permits/renewals aren't all that much. Here's an old 2013 list of some figures by state:
https://www.outdoorlife.com/blogs/g...es-it-cost-own-firearm-state-state-breakdown/

The major cost is for guns and accessories, ammo, lessons, target range practice, etc. Not everyone can afford that, not everyone could possibly
handle one...little kids, elderly, limited mobility, blind. It's a lot easier to limit availability of guns to those with a violent troubled history. Why should the
deranged nuts be allowed to stain the reputation of law abiding gun owners?

Costs can vary from nearly $1,000 in New York City to satisfy all mandated training and range proficiencies to anywhere from $200 to $480 for a two-year CWC in California, to $206.50 for a five-year permit in Connecticut, to $20 for a five-year permit in Pennsylvania, to $10 for a four-year permit in New Hampshire.

If you think that it's easy for most people to spend that kind of money in NYC or cali, you are out of touch with mainstream america

you'll need to expand upon that theory....................are you saying that deranged nuts have better financial skills to afford those things than sane individuals?

if the accusation has no merit it would be shown in the hearing -so why would property be confiscated?

Have you even educated yourself on how a "red flag law" works; because you are in favor of it, but seem to not even have a clue as to what it means??

Red flag law

A red flag law is a gun violence prevention law that permits police or family members to petition a state court to order the temporary removal of firearms from a person who may present a danger to others or themselves. A judge makes the determination to issue the order based on statements and actions made by the gun owner in question. Refusal to comply with the order is punishable as a criminal offense. After a set time, the guns are returned to the person from whom they were seized unless another court hearing extends the period of confiscation.

UH - Marijuana is not mentioned in the Constitution, so your attempt to connect the two is a fallacy.

Thanks- that is what I wanted to hear from Dumber-than-a-box-of-hair! LOL!

But, point is, there are Federal laws on Marijuana in the US code making it illegal- same as machine guns, grenades ,other street drugs, etc....................

well, you're sorta right wiht the whole flip flopping shit, but it's still tyranny no matter how you look at it.

Everybody wants to call themselves a Llibertarian- Until somebody steps on someones dick! Then they want to be called a Conservative- when in fact, all of us are fucking liberals- All of us! We just lean right and left!

i've been on record, forever, on this forum that there are things outside the federal governments power, marijuana being just one of them. if you think that just because the government makes a law, that's the bottom line, you've failed as an American.

what kind of stupid question is this? ( bolded)
as to rights -yes they are limitless- but they can also be regulated

nope, and in case you haven't noticed lately i've been getting hammered from people on both sides because I don't lean right or left........but with the constitution. something most people don't even understand

no, you just seem to be advocating a litmus test for sanity and forcing extra costs to survive them

I already covered all that. If there are witnesses to "cruel, violent behavior", etc. he needs to be checked into and have the accusation verified or found false.
Did you ever own your business and pay for the background test on a potential employee?
Did you ever buy a used car without getting it thoroughly checked over first?
Buy a dozen eggs without taking a look at them first?

it goes to trying to understand your mindset of 'does the constitution give the federal government the power to define it's limits'...................so does it?
why don't you make your point instead of asking a poorly worded question?
what is "it's" ? the government itself? the rights?

then you don't understand rights.
as previously stated take it up with SCOTUS
