Abortion in many states is not legal. Petti resisted arrest and reached for a weapon. Or reached where his weapon was and possibly his backup weapon. His shooting was unfortunate. But is was legal. The case will like go to a grand jury but it will hinge on what a reasonable officer would do at the moment. Fighting officers and reaching to your waste band where you keep your gun will get you shot most of the time. Renee Good rammed an ICE officer with her car whether it was accidental or on purpose no one knows for sure. But what is for sure the officer feared for his life and the lives of others. If Good or Pettii had not resisted arrest they both would be alive today.

When I was in my internship I did an OB rotation at Ft. Hood. I was following a 4th year OB resident. We got called the ER to examin a female soldier with abdominal pain and vaginal bleeding and discharge. Turned out that she had a legal abortion in Houston 3 days before. Of course the abortionist wasn't on staff or on call so this poor woman had no one to help her for the abortion clinic. Anyway when we examined her she has a leg and tissue in her cervix. We had to take her to the OR for an emergency DNC. So sometimes these abortionist cause life threatening emergencies.
While resisting arrest and carrying a weapon on his person he was disarmed by one agent while they all were made aware that he was armed. No one announced that Petti's primary weapon had been removed. Then he reached for his holster area a reasonable officer might assume he had another weapon or a reasonable officer might not even be aware that Petti had been disarmed. Petti reached for his waste band and had a dark object in his right hand if you wait a fraction of a second for a closer look you or another officer might be dead.
As I said his shooting was unfortunate but it is 100% understandable and legal. It could have been avoided if Petti had not resisted arrest. Petti was armed and carrying extra ammunition he was clearly look for confrontation.

He never reached for his holster, both hands were on the ground when he was shot for the first time. After the first shot, he reached around to the area in his back where the bullet hit, natural response.
