Share Print CommentsSAN FRANCISCO — Marijuana advocates are gathering signatures to get as many as three pot-legalization measures on the ballot in 2010 in California, setting up what could be a groundbreaking clash with the federal government over U.S. drug policy.

At least one poll shows voters would support lifting the pot prohibition, which would make the state of more than 38 million the first in the nation to legalize marijuana.

Such action would also send the state into a headlong conflict with the U.S. government while raising questions about how federal law enforcement could enforce its drug laws in the face of a massive government-sanctioned pot industry.

The state already has a thriving marijuana trade, thanks to a first-of-its-kind 1996 ballot measure that allowed people to smoke pot for medical purposes. But full legalization could turn medical marijuana dispensaries into all-purpose pot stores, and the open sale of joints could become commonplace on mom-and-pop liquor store counters in liberal locales like Oakland and Santa Cruz.

Under federal law, marijuana is illegal, period. After overseeing a series of raids that destroyed more than 300,000 marijuana plants in California's Sierra Nevada foothills this summer, federal drug czar Gil Kerlikowske proclaimed, "Legalization is not in the president's vocabulary, and it's not in mine."

The U.S. Supreme Court also has ruled that federal law enforcement agents have the right to crack down even on marijuana users and distributors who are in compliance with California's medical marijuana law.

But some legal scholars and policy analysts say the government will not be able to require California to help in enforcing the federal marijuana ban if the state legalizes the drug.

Without assistance from the state's legions of narcotics officers, they say, federal agents could do little to curb marijuana in California.

Both the city and county of Los Angeles have the so called medical marijuana shops in the cross-hairs. They are using the law to say that they should not make any profit and that it should be like a commune, where everyone contributes.


At hundreds of medical marijuana dispensaries in Los Angeles, cash is changing hands, typically about $45 for an eighth of an ounce.

The dispensary owners call it a donation because state law requires their stores to operate as nonprofit collectives. But their critics -- police, the district attorney and the newly elected city attorney -- insist that it's a sale and that marijuana sales remain illegal under state law.

That has irked law enforcement officials who argue that many, if not most, of the dispensaries operate as nonprofit collectives in name only. Next week, police officers and prosecutors from around the county plan to meet for a training lunch to discuss "the eradication of medical marijuana dispensaries."

L.A. County Dist. Atty. Steve Cooley and City Atty. Carmen Trutanich have decided that, based on a state Supreme Court decision issued last year, the way most dispensaries in California distribute marijuana violates state law. Neither was available to comment Wednesday.

The proposal would require dispensaries to be at least 1,000 feet from schools, parks, libraries, religious institutions, child-care facilities, youth centers, hospitals, drug rehab centers and other collectives.

The ordinance also restricts operating hours to 10 a.m. to 8 p.m. and requires that membership, cash flow and inventory records be available for inspection without a search warrant or court order.

Looks like not everyone in California is on board with legalization.
 
Cali is a big state obviously their are plenty police state types that want no part of legalization and will fight and ignore what has already passed.
It's prob the most liberal state and yet has plenty nazi types to go around.
 
Here's what Brown the ATT GEN put out as standards. Which many are likely violating. I'd kill to get this in LA.

The new guidelines:

Medical marijuana patients should apply for state issued ID cards that the California police should hold legitimate. (a verification database will be found online)
patients and authorized caregivers should have no more than 8 oz. of processed marijuana (Doctors may recommend more and only the female marijuana bud is to be counted towards this weight.)
Patients and authorized caregivers should have no more than 12 immature or 6 mature plants (Doctors may recommend more.)
If Patients appear to have excess marijuana, all marijuana can be confiscated.
Patients should not use their medicine near schools.
Patients should not use their medicine at work (unless the employer gives consent.)
Non profit collective or cooperative medical dispensaries are legal but for profit businesses are not.
Sales of Medical Marijuana are subject to a tax but no profit can be made from the sale.
Dispensaries are prohibited from buying marijuana from illegal commercial grows (they must obtain the medicine from patients or caregivers with “fees limited to covering overhead and operating expenses.”

absolutely right....the local sheriff here abused his discretion under CA laws and went after a local medicinal shop here by circumventing the local authorities and going directly to the feds.....

most view the sheriff as a traitor around these there parts.....:cool:
