before 1930, the constitution used to be read as limiting government actions, so 'shall make no law' meant 'shall make no law'. But since 1942, the constitution now gets read so that the governments power is nearly unlimited, so it is relatively easy to understand that it's legal for the government to practice religious discrimination.
