Many legal experts think the president is immune from most criminal prosecutions. It is all far from certain, but it would incredibly muddy the waters.

New York State has several admissions of guilt from the trump organization, and the trump trust. That could be used in a prosecution of trump when he left office. Again, nothing certain, but something trump should be worried about.

And presidential immunity does not extend to those around trump. We have seen as they go to prison by the dozen that they are not protected.

Republicans weren’t happy with how the democrats handled the House inquiry and Democrats are whining about how republicans are handling the Senate trial.

Everyone should be happy lol.

I thought the immunity from criminal prosecutions was just a Justice Department policy and only applied to federal prosecutions.

No one really knows. The Justice Department has its theory. A lot of other people have their theories.

I do not think anyone really wants to test it either.

I agree, although if it is a DOJ policy that means they will not attempt to prosecute real crimes. I don't know if that is more of a roadblock than the fact that the DOJ would be reluctant to undertake a prosecution of their boss.

In theory, the president can order the DOJ to stop any investigation, or prosecution. If they fail to stop, the president can fire those who are doing the investigation, or prosecution. Many political appointees serve at the pleasure of the president, so could easily be fired.

All this happened when Nixon was in office. He ordered the Attorney General to drop the Watergate investigation. Both the Attorney General and Deputy Attorney General were required to resign rather than shutdown the investigation. Finally Bork(yes, that Bork) agreed to be Attorney General on the condition he would kill the investigation. It was called the Saturday Night Massacre.

There is a question whether the Attorney General of New York could arrest the president. There are many legal scholars who say no. If the president used his powers to resist, then it would be impossible to actually arrest him.
