Pennsylvania AG (D) Shuts Down Corruption Sting After Only Democrats Are Caught

The Pennsylvania Attorney General's Office ran an undercover sting operation over three years that captured leading Philadelphia Democrats, including four members of the city's state House delegation, on tape accepting money, The Inquirer has learned. Yet no one was charged with a crime.

Prosecutors began the sting in 2010 when Republican Tom Corbett was attorney general. After Democrat Kathleen G. Kane took office in 2013, she shut it down.

In a statement to The Inquirer on Friday, Kane called the investigation poorly conceived, badly managed, and tainted by racism, saying it had targeted African Americans.

Those who favored the sting believe Kane killed a solid investigation, led by experienced prosecutor Frank G. Fina, that had ensnared several public officials and had the potential to capture more. They said they were outraged at Kane's
allegation that race had played a role in the case. Before Kane ended the investigation, sources familiar with the inquiry said, prosecutors amassed 400 hours of audio and videotape that documented at least four city Democrats taking payments in cash or money orders, and in one case a $2,000 Tiffany bracelet.

Typically, the payments made at any one time were relatively modest - ranging from $500 to $2,000 - but most of those involved accepted multiple payments, people familiar with the investigation said. In some cases, the payments were offered in exchange for votes or contracts, they said.

Sources with knowledge of the sting said the investigation made financial pitches to both Republicans and Democrats, but only Democrats accepted the payments.

The investigation's undercover operative was a little-known lobbyist, Tyron B. Ali, 40, who agreed to wear a wire and tape the officials to win favorable treatment after his arrest in a $430,000 fraud case, the newspaper has learned.
In an unusual move, the Attorney General's Office then dropped the fraud charges secretly, under seal, last fall. Robert J. Levant, a lawyer for Ali, said neither he nor his client would have any comment.

People with knowledge of the investigation said those caught on tape included former Traffic Court Judge Thomasine Tynes, who acknowledged that Ali gave her the bracelet. Four state lawmakers took money, the sources said. State Rep. Ronald G. Waters accepted multiple payments totaling $7,650; State Rep. Vanessa Brown took $4,000; State Rep. Michelle Brownlee received $3,500; and State Rep. Louise Bishop took $1,500, said people with knowledge of the investigation. Bishop denied receiving money. Brownlee said she couldn't recall taking a payment, and Brown declined to discuss the matter.


Sources say that as money changed hands, the conversations were often blunt.

In May 2011, Ali went to Brown's office and handed her an envelope with $2,000, according to people who have reviewed a transcript of a tape Ali made on that day. As Brown accepted the money, they said, she put it in her purse and said: "Yo, good looking and Ooowee. . . . Thank you twice." After he gave Brown the money, Ali urged her to vote against a bill that would require voters to show identification at the polls, the sources said.
Brown voted against the measure - as did every other Democrat in the House.

In an interview Saturday, Brown's lawyer, Wadud Ahmad, said she had done nothing wrong. He said he had not been contacted by law enforcement and knew little about the investigation.

Ahmad, a former prosecutor, said, "I have never seen a prosecutor or any federal agent give someone a pass when they have strong evidence that they did something wrong."

Waters, for his part, said he did not recall receiving any money from Ali, but later added: "I'm trying to remember if he gave me something for my birthday." In April 2011, to mark Waters' 61st birthday, Ali gave him $1,000, and the transaction was recorded on tape, according to people who read a transcript of the conversation. As Ali handed Waters an envelope, the sources said, Ali told him: "Hey, there's $1,000 in there, bro."

Or they knew him but had no memory of accepting his money.They dined with him, but he was just another lobbyist.

That is how five leading Philadelphia Democrats who sources say were caught on tape in a sting investigation described their relationship with Tyron B. Ali, who went undercover for the state Attorney General's Office.
After the recordings were made, prosecutors do not appear to have contacted the elected officials or interviewed them about the lobbyist.

None of the five reported receiving gifts or campaign money from him on official disclosure forms in recent years. While state law sets no limits on the dollar amount of gifts lawmakers may accept, annual disclosure is required.

"Yesterday’s big Inquirer story is pretty complex, and the gigantic font they used for the headline certainly makes it seem like they must’ve caught Kane doing something pretty bad . But in reality it looks like there’s a lot less here than meets the eye.

1. This story was clearly fed to the Inquirer by Frank Fina, a former top deputy to Tom Corbett when he was Attorney General. Kathleen Kane is probing Fina’s botched handling of the Sandusky case, and the Corbett team is anxiously awaiting the release of that report.

The release of the Sandusky report will of course be one of the major events in the 2014 race for Governor, and the Fina and Corbett people have been encouraging the view that it would somehow be inappropriate to release the report during election season. Heaven forbid Tom Corbett be held accountable for the performance of his prior elected office.

It’s pretty hard not to come away thinking that this is Fina trying to throw some dirt on Kane ahead of the release of the Sandusky report. If he can color her actions as politically motivated in this case, people may be more receptive later when he inevitably says the Sandusky probe, or the timing of its release, is politically motivated.

2. Kathleen Kane’s targets for political corruption investigations don’t reveal any partisan pattern.

The charges against Democratic state Senator LeAnna Washington are just the latest example that puts the lie to the Fina/Corbett camp’s anonymous sources’ accusations that Kane is avoiding going after Philly Democrats in order to advance her statewide political ambitions. First of all that doesn’t even make political sense. “Racially conservative” Democrats in the rest of the state would love it if Kane went after the Philadelphia delegation. Second off all, as her statement responding to the Inquirer story notes, the majority of the public corruption cases she’s brought involve Democrats:

“My record speaks for itself that prosecutions have no political agenda. Of the 11 public corruption cases we have brought so far, the majority involve Democrats. I will not sit back and allow lies from those who seek to destroy the public’s trust in me or my office.”

This skewed (toward Democrats) record invalidates the central premise of the story, but the Inky still ran with it anyway for some reason.

3. There’s no evidence of a quid pro quo gifts for votes scandal

The Inky article simply doesn’t have the goods on any link between gifts and votes. A Democrat doesn’t need a Tiffany bracelet to be persuaded to vote against Voter ID!

Did the sting Kane cancelled catch some Philly Democrats doing stupid things? There’s no question about it. Did it catch anyone doing illegal things? Well, you have non-disclosure of gifts, which Adam Bonin has been pointing out is a misdemeanor. And he also notes there’s no legal limit on the gifts politicians (or their spouses) can accept from lobbyists. They just have to be disclosed, and there can’t be a quid pro quo – a connection that the Inky article emphatically does not make.

Everyone should absolutely be scandalized by the ridiculously weak state ethics laws concerning gifts, and we should pass a new state law at least as strict as what’s being proposed in Philadelphia. That’s the correct target for people’s ire here.

You think you know all the legal ramifications more than Kane? Maybe you should run for her office. Looks like the previous AG (R) royally screwed this even before it landed in Kane's lap. I can imagine the uproar if she filed charges based on a flawed investigation. Well, maybe not. After all 96% of those targeted were African-American and that would appeal to a lot of people here.

And what about the fact that only Dems were targeted in this sting that started with a repub governor and AG?

"The attorney general's office determined it could not prosecute for several reasons, Ms. Kane said, most importantly because it concluded the credibility of the confidential informant had been ruined by an agreement, signed after Ms. Kane was elected but before she took office, that absolved the informant of more than 2,000 charges related to accusations of fraud. The informant, who posed as a lobbyist, was the only witness present when the tapes were made, she said...

"The credibility of the CI was completely shot," she said, describing the dismissal of the charges. "His credibility was ruined at that point, absolutely ruined. To get any of the evidence into court beyond that was almost impossible."

There also was evidence of racial targeting, Ms. Kane said, including the word of one person who told the attorney general's office and a second person who told another law enforcement agency that they were instructed to target black legislators. Of 113 tape recording sessions, 108 featured African-American targets, according to the attorney general's office..."

In a separate memo to Kelly dated July 26, 2012, Fina asked Kelly for direction on whether to: prosecute the individuals who had accepted cash to that point; try to gain their cooperation for a broader probe of the practice of bribing lawmakers for policy votes or state funding; or to invest more resources and staff into the case to continue the probe.

It was unclear what Kelly’s response, if any, to that memo was, but she took no public action on the case."
