AFAIK, most cities require a permit to march, but the process is mostly formal. I'm sure Pedo Don's rally was completely legal. It's when the Proud Boys and Oath Keepers led the rally attendees to attack the Capitol and breech the police line that it became a criminal action at best and treason at worst.
IMO, all of those who took an oath to support and defend the Constitution should be treated as traitors and punished accordingly.
