Shitty and stupid as this is, it's the property owners right to exercise. Just as any business reserves the right to not serve anyone, it's their property and therefore, their rules.

and if the restrictions are there and you agreed to them....you would have to abide....

now if this is some new rule, not agreed upon....different story, then the management has to wait until the lease or hoa agreement runs and then have you sign a new agreement.....

i find it hard to believe that the big red house you have said is your home has all those restrictions on it.....your hoa is nuts....

1. Can't argue with that.
2. Most HOAs require a 2/3 majority for a rule change- a major effort.
3. The house is brick- very economical in The South. Our restrictions are nearly identical to other neighborhoods that I am familiar with. In fact I have a POA agreement in the mountains and its pretty similar as well. The whole idea is to keep the 'hood looking good to increase curb appeal and therefore property values.

ALBANY, Ore. - At the Oaks Apartments in Albany, the management can fly their own flag advertising one and two bedroom apartments - but residents have been told they can't fly any flags at all.

"This flag stands for all those people," said Clausen, an Oaks Apartment resident. "It stands for the people that can no longer stand - who died in wars. That's why I fly this flag."

But to Oaks Apartment management, Clausen said, the American flag symbolizes problems.

He was told to remove the red, white and blue from both of his rides, or face eviction.

"It floored me," he said. "I can't believe she was saying what she was saying."

Even long-time residents like Sharron White, who has flown a flag on her car for eight years, has been told to take it down.

White said management told her that "someone might get offended."

"I just said to her 'They'll just have to get over it,'" White said.

Resident we talked to who had been approached to take down their flags all told us the same thing: that management told them the flags could be offensive because they live in a diverse community.

Attempts to find out for ourselves why management would ban flags were unsuccessful. KATU wanted to talk to management at Oaks Apartments, but no one has returned our calls. The woman we were told had made the decision said she was "not going to answer any questions."


Other than IB1 and TCLiberal, I'll go out on a limb and guess there might be at least one or two Democrats that find this as freekin' insane as I do....

Do you not belive in individual property rights? Are you saying the government should be able to come in and tell the property owners what they have to allow and not allow on property they own?

"If people want to fly any flag of any nationality, it's their right," said Barb Holcomb with Oaks Apartments.


Looks like the property manager has more legal smarts than our ambulance chasers here....

Homeowners associations have what's called CC and R's. They can do this. Some will say one can't have certain colored drapes if they can be seen from outside, etc. I would never live in one, myself.

I'd never fit in a place like that. There's just something about rules I don't like.

your last sentence is just plain stupid and not true....i said that if it was in the agreements, eg, CCR's, then it was legal....i did not have access to the policy or agreements as the manager did and after looking at the policy, realized he has no legal standing....
