President Obama has nominated Merrick Garland to serve on the Supreme Court, setting up a protracted political fight with Republicans who have vowed to block any candidate picked by Obama.

Garland, 63, is a longtime Washington lawyer and jurist who is chief judge of the U.S. Court of Appeals for the District of Columbia Circuit.

Considered a moderate, Garland is widely respected in the D.C. legal community and was also a finalist for the first two Supreme Court vacancies Obama filled.

GOP lawmakers, though, have said since Scalia’s death that they have no intention of holding a hearing or a vote on the president’s pick.

Sen. Mike Lee, Utah Republican and a member of the Judiciary Committee, reiterated Wednesday that the GOP won’t consider the nominee.

“In light of the contentious presidential election already well underway, my colleagues and I on the Judiciary Committee have already given our advice and consent on this issue: we will not have any hearings or votes on President Obama’s pick,” Mr. Lee said. “Any meeting with any nominee put forward by President Obama would only be a waste of the Senate’s time. The Court has very ably dealt with temporary absences in the past and will do so again now.”

Judge Nap: Garland Is Most Conservative Nominee by a Dem in the Modern Era

Judge Andrew Napolitano reacted this morning to President Obama's nomination of Merrick Garland to replace the late Antonin Scalia on the Supreme Court.

Garland, 63, is Chief Judge of the United States Court of Appeals in D.C. Napolitano called Garland the "consummate Washington D.C insider," having worked as a prosecutor in the first Bush administration before being nominated as a federal judge by Bill Clinton.

"Judge Garland is the most conservative nominee to the Supreme Court by a Democratic president in the modern era," said Napolitano.

If Garland is confirmed, Napolitano said that he would not be the same kind of judge as Obama's previous choices, Sonia Sotomayor and Elena Kagan.

"He does not think about the law the way Barack Obama does," the judge explained, adding that it's a "lose-lose" for the president because liberals also will take issue with the pick.

Napolitano said Obama chose Garland as a way to "pry loose" Republicans who might otherwise oppose the nomination.

He predicted that the Senate will stand firm on not holding a vote on Obama's nominee, explaining that the decision rests solely with Senate Majority Leader Mitch McConnell.

"The law in the Constitution is the Senate makes its own rules and move at its own pace. It cannot be told what to do by the president," said Napolitano.

Its a dangerous game the Republicans are playing, they very well might end up with a much more liberal judge due to this course of action.
 

Clinton wins the general and the dems take back the senate when republicans stay home rather than vote for Trump, she nominates Obama for the SC seat, he is accepted and handily wins approval.
Afraid of an Obama nomination, the GOP could end up with Obama himself on the court.
It could happen.
