authorized to take proof and make a determination of the relevant facts
and to issue subpoenas in accordance with the civil practice law and
rules. Such authorization shall not abate or terminate by reason of any
action or proceeding brought by the attorney general under this section.

Exactly who did he defraud? If he paid off the loans in full, it doesn't matter one iota what he put on some form about his property or wealth. To be defrauded, the party has to have suffered harm and monetary loss. No loss, no harm.

A state prosecutor suing in civil court is a true rarity. This means that the prosecutor's case is so weak they can't bring criminal charges so they're trying civil charges because the standard of evidence is lower. Seems the incompetents in NY's prosecutor's office is grasping at straws because their TDS got the better of them.

The first question the defense should bring up is Why is the prosecutor's office pursuing a civil lawsuit for tax issues? Isn't this something the state income tax people should be bringing up since they were the ones potentially affected by this?

So, Bourbon, why is a NY state prosecutor who deals in criminal charges bringing a civil suit against Trump for tax issues instead of the state tax bureaucracy? It isn't the prosecutor that suffered potential harm, but the state tax agency. Normally in a civil suit you need standing--eg., you were the party harmed--to bring a suit. It isn't the purview of the prosecutor's office to bring civil tax suits. If she (the prosecutor) has such a weak case she can't bring criminal charges, why didn't she refer this to the tax agency for action?

We know the answer, the prosecutor absolutely hates Trump and is going to try and get him even as she makes an ass out of herself.

As I said in the last post, her case is NOT "weak". She has actual evidence trump cheated. trump's accounting firm dumped him because they won't stand by his numbers.

Again, the case is iron clad, which is the opposite of what you claim. When trump values a property at 10 times the appraised value to get a loan, and James has the appraisal, the evidence is pretty clear.

2. You need standing in civil suits. You have to demonstrate you were the party harmed by the person or company you are suing.
3. Her issue is on Trump's taxes and whether he paid them fairly.

Conclusion: That is an issue for NY state's income tax people, not a criminal prosecutor.

It's also bank fraud, because when twump needed to say afloat, he inflated the value of his properties as collateral. It's clearly bank fraud. She's making criminal referrals as well, don't worry.

Well, she is a prosecutor. That's one of her roles as AG. TA's argument is that the case is weak because she's bringing a civil action instead of a criminal one. What TA's ignoring is the reasoning for it and the fact it won't be over after her lawsuit is done, she's submitted evidence to the Fed and to the IRS. James is doing fine. Alleging a widespread effort to manipulate property valuations by former President Donald Trump, three of his children, and their eponymous company, New York Attorney General Letitia James announced Wednesday her office is suing them, seeking $250 million and an end to their operations in the state.

"We are attempting as part of this lawsuit to dissolve these corporations," James said at a news conference Wednesday.
