NY AG suing Donnie for fraud

A state prosecutor suing in civil court is a true rarity. This means that the prosecutor's case is so weak they can't bring criminal charges so they're trying civil charges because the standard of evidence is lower. Seems the incompetents in NY's prosecutor's office is grasping at straws because their TDS got the better of them.

The first question the defense should bring up is Why is the prosecutor's office pursuing a civil lawsuit for tax issues? Isn't this something the state income tax people should be bringing up since they were the ones potentially affected by this?

It isn't the prosecutor that suffered potential harm, but the state tax agency. Normally in a civil suit you need standing--eg., you were the party harmed--to bring a suit. It isn't the purview of the prosecutor's office to bring civil tax suits. If she (the prosecutor) has such a weak case she can't bring criminal charges, why didn't she refer this to the tax agency for action?

I was wondering if anyone was going to notice that. You are exactly right. Despite this, they still need actual evidence. The prosecutor can't just go in there with spit and shout. The only thing that could possibly help the prosecutor is a biased court.

Actually the first question is to move the venue outside of New York, say to a federal court, and then file a counter-suit against the NY AG.
