Yes, it is. Looks like they're trying to screw him out of his pension. Hopefully, the union can get him reinstated.
 
Without a union he gets fired and has no recourse even if it is total bullshit. At least with the union he can go through the grievance process and at least get a hearing and a modicum of due process.

I'm not a lawyer so I ask the question. Are you saying that unless you belong to a union an employee cannot sue a company for wrongful termination?

Typically no, because you're usually an at will employee. Of course there are exceptions, for things like gender discrimination and what not.

We have Industrial Tribunals over here, who you can turn to if you consider that you've been wrongfully dismissed. They are one very good reason why companies in the UK do not drugs test employees like the US. No doubt somebody will say that it smacks of Socialism!

For something like this, a non-union at-will employee can sue but can't win. With a union, depending on the specifics of the collective bargaining agreement, he can possibly get his job (and chance at pension) back.

I expect so....unions regularly get people their jobs back even when they fuck up so bad that other employees suffer......
