What she's "taking" is the right to bear arms... and it is still just as unconstitutional. Most of us expect their leadership to follow their oaths of office, not tell folks that they don't have to if they utter the magic word "emergency". Do better NM, just do better.


It may very well be, taking the Constitution literally, unconstitutional.

That's one reason why we don't all the share the same respect for the Constitution.

To me, it was a probably well-intended but horribly executed document

that could be easily improved upon

by any 1st year Harvard Law School student today.

States have the right to issue and revoke gun permits. She is suspending permits for 30 days. It is within her authority to do so.

New Mexico does not require a 'permit' to open or concealed carry, so she is not suspending permits, she's denying a constitutional right for 30 days, therefore it is NOT within her fucking authority

The Constitution can not be taken literally, even Jefferson had to admit such when he purchased Louisiana, it is not some static document authored over two centuries ago that can be literally applied to all circumstances in contemporary times
 
Where does it say on the Constitution that you have the absolute right to pack a gun anywhere or anytime you want?

this New Mexico example, alone, should tell you idiots that 'no right is absolute' is a crock of shit and NOT to be tolerated........don't think for a second that some jackbooted republican governor is thinking of using an emergency to deny some other right that you will care about.

to specifically address your question, try 'shall not be infringed', or the New Mexico Constitution - "No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes,"

another shining example of someone who NEEDS government to think and do for them. It's IDIOCY to try and use examples of founding fathers going outside the Constitutional limits prescribed to them. ALL of them, upon becoming president, hated the fact that it restricted them from doing what they wanted to............which is why they fought for it in the first place.

The Constitution is a legal document, thus it's meaning does not change from generation to generation. If no power is prescribed, they don't get to make up a reason to skirt it.

Democratic New Mexico Gov. Michelle Lujan Grisham said she would welcome a fight after announcing an emergency order to suspend the right to carry firearms in most public places around Albuquerque. That’s exactly what she’s getting.

Since she issued the 30-day public health order on Friday, a furor has rained down from gun owners, state Republican lawmakers and civil rights advocates. Even some in her own party questioned the move.

The sheriff who oversees the county that includes New Mexico’s largest city, Albuquerque, vowed Monday not to enforce it, joining the county’s top prosecutor, and the Albuquerque mayor and city’s police chief.

Gun-toting protesters held a peaceful rally in Albuquerque’s Old Town area with another scheduled Tuesday in the heart of Albuquerque.
