2....The fine was taken from your tax refund check by the IRS
3....If you refused to pay the FINE, you would be subject to "civil and criminal penalties for noncompliance." of the tax code. IRS again.

The Code provides for both civil and criminal penalties to ensure complete and accurate reporting of tax liability and to discourage fraudulent attempts to defeat or evade tax"

This FINE, because it was to be collected from you taxes would now be considered 'non-payment of taxes' and that could mean JAIL TIME....Just like O'Reilly claimed.

Big fucking deal....penalty taxes or "fines" exist for housing codes, car insurance, etc. You pay them to the county or State or the Fed depending upon the infraction......that's been the case for a LONG time.

Like car insurance, the proposed bill requires that you get health insurance of some kind (with or without gov't assistance)....if you don't and something happens, you'll get fined. Similarly, if you close out your IRA before a certain age, you get a penalty tax. Failure to pay such fines or taxes MAY result in prosecution and incarceration, depending upon circumstances. That's been around since I was a babyFox Noise just said, "NO INSURANCE, YOU GO TO JAIL"....knowing full well that the proposal at the time was not that absolute.

Actually, thanks to public outcry, the Dems threw in a pacifier that points out going to jail is highly unlikely and not really enforceable for most cases. Remember genius, the language is still there for fines to be levied...especially if companies refuse to provide health insurance for their employees. Refusing to comply with those two parts could lead to an appearance in court, and possible jail sentence. Lawyers always leave themselves wiggle room when dealing with criminal intent on any level.
